GENERAL
TERMS AND CONDITIONS – FORZA FIT B.V.
1.
General
1.1 These
General Terms and Conditions apply to all agreements between Forza Fit B.V. and
its members and are governed exclusively by Dutch law.
1.2 Forza
Fit B.V. is located at Schipborgstraat 4, 2541 PL, The Hague, The Netherlands.
1.3 By
signing the membership agreement, the member confirms that they have read and
accepted these General Terms and Conditions and the House Rules.
1.4 Forza
Fit reserves the right to request valid identification upon registration and
during the membership period.
1.5
Membership is personal and may only be used by the registered member.
2.
Membership
2.1
Membership is entered into for the contract period specified on the membership
agreement.
2.2
Membership is strictly personal and non-transferable without prior written
approval from Forza Fit.
2.3 Access
to the club is granted only through a valid membership card, app, or any other
access system designated by Forza Fit.
2.4 Forza
Fit reserves the right to refuse a membership application without providing a
reason.
2.5 Members
under the age of 18 must have their membership agreement co-signed by a parent
or legal guardian.
3.
Membership Types and Fees

3.2 Current
membership fees are available at reception, on the membership agreement, and on
the website.
3.3 All
prices include VAT unless stated otherwise.
3.4 Forza
Fit reserves the right to adjust membership fees annually due to inflation,
increased operating costs, investments, market developments, and facility
improvements.
3.5 Members
will be notified of any fee changes at least 30 days in advance.
4.
Payments
4.1
Membership fees are collected every four (4) weeks in advance via direct debit.
4.2 In the
event of a failed payment, Forza Fit may charge an administration fee of €7.50.
4.3 Forza
Fit reserves the right to suspend access to the club immediately in the event
of overdue payments until all outstanding balances have been settled.
4.4 All
contractual payment obligations remain valid in the event of payment arrears.
4.5 Any
collection, legal, or recovery costs incurred will be charged to the member.
4.6
Membership fees, registration fees, and administration fees are non-refundable.
5.
Cancellation and Termination
5.1
Membership cancellation must be submitted in writing via email or through the
official cancellation form provided by Forza Fit.
5.2 Early
termination of a fixed-term membership is only possible in the following
situations:
Relocation to a residential
address more than 25 kilometers from Forza Fit;
Long-term medical circumstances
preventing participation.
5.3
Supporting documentation may be requested before approval is granted.
5.4 Upon
expiration of the agreed contract term, the membership automatically converts
into an indefinite membership.
5.5 After
conversion, a notice period of one month applies.
6.
Temporary Membership Freeze
6.1
Membership may be temporarily frozen in the event of long-term illness, injury,
or pregnancy.
6.2
Requests must be submitted in writing.
6.3 Forza
Fit may require medical documentation or other supporting evidence.
6.4 A
freeze may be granted for a maximum period of six months.
6.5
Membership freezes cannot be applied retroactively.
6.6 The
membership contract will be extended by the approved freeze period.
7.
Opening Hours and Facilities
7.1 Forza
Fit reserves the right to modify opening hours.
7.2 Opening
hours may differ during public holidays, vacation periods, maintenance work, or
exceptional circumstances.
7.3
Temporary closure of parts of the facility does not entitle members to a
refund.
7.4 Group
classes, schedules, and facilities may be changed without compensation.
7.5 Forza
Fit reserves the right to temporarily remove equipment, rooms, or facilities
from use for maintenance, repairs, or replacement.
8.
Health and Safety
8.1 Members
declare that they are physically capable of participating in sports and fitness
activities.
8.2 Members
are responsible for informing Forza Fit of any medical conditions that may
affect safe participation.
8.3 Members
are advised to consult a physician before participating if there is any doubt
regarding their health condition.
8.4
Participation in activities and use of equipment is entirely at the member's
own risk.
9. House
Rules
9.1 The use
of a towel during workouts is mandatory.
9.2 Clean
indoor sports shoes are required.
9.3
Equipment must be cleaned and left tidy after use.
9.4
Harassment, intimidation, discrimination, or offensive behavior toward members
or staff is not permitted.
9.5
Smoking, drug use, and excessive alcohol consumption are prohibited within the
facility.
9.6 Members
must follow instructions provided by Forza Fit staff.
9.7
Violation of the house rules may result in temporary or permanent suspension
without refund.
10.
Personal Training
10.1
Personal Training services are not included in a regular membership.
10.2
Personal Training sessions are available from €75 per session.
10.3
Sessions must be paid for in advance unless otherwise agreed in writing.
10.4
Sessions must be cancelled at least 24 hours in advance.
10.5
Cancellations made within 24 hours of the scheduled session may be charged in
full.
11. EMS
Training
11.1 EMS
Training is offered as an additional service.
11.2
Additional terms and fees may apply to EMS Training.
11.3
Participants are required to disclose any medical conditions, limitations, or
contraindications before participation.
11.4 Forza
Fit reserves the right to refuse participation in EMS Training if deemed
necessary for health and safety reasons.
12.
Privacy and Personal Data
12.1 Forza
Fit processes personal data in accordance with the General Data Protection
Regulation (GDPR).
12.2
Personal data is used solely for membership administration, payments,
communication, and service delivery.
12.3
Personal data will not be sold to third parties.
12.4 The
Privacy Policy is available upon request and via the website.
13. CCTV
Surveillance
13.1 CCTV
surveillance is in operation within and around the premises of Forza Fit.
13.2 CCTV
footage is used solely for security purposes and the protection of members,
visitors, employees, and property.
13.3 CCTV
footage is processed in accordance with GDPR regulations and will only be
provided when legally required.
14.
Liability
14.1 Use of
the facilities is entirely at the member's own risk.
14.2 Forza
Fit shall not be liable for loss, theft, or damage to personal belongings.
14.3 Forza
Fit shall only be liable in cases of gross negligence or intentional
misconduct.
14.4 Use of
lockers is at the member's own risk.
15.
Photography and Video Recording
15.1 Photos
and videos may be taken during classes, events, and activities for promotional
purposes.
15.2
Members who object to the use of their image must notify Forza Fit in writing
in advance.
16.
Force Majeure
16.1 Forza
Fit shall not be liable for temporary closure or limitation of services
resulting from force majeure.
16.2 Force
majeure includes, but is not limited to: fire, flooding, power outages,
pandemics, government measures, technical failures, natural disasters, and
other unforeseen circumstances.
17.
Final Provisions
17.1 If any
provision of these Terms and Conditions is found to be invalid or
unenforceable, the remaining provisions shall remain fully effective.
17.2 Forza
Fit reserves the right to amend these Terms and Conditions.
17.3 The
most recent version of these Terms and Conditions is available at reception and
on the website.
